1. Acceptance

By accessing canyoncontrols.com (the “Site”) you agree to these Terms of Use. If you do not agree, do not use the Site. If you are using the Site on behalf of a firm, you represent that you are authorised to bind that firm to these terms.

2. Informational purpose

The Site is published for architects, engineers, lighting designers, distributors, representatives and contractors as a source of product information. It is not a store. Nothing on the Site constitutes an offer to sell, a quotation, a price, a commitment to supply, or a contract. Orders are placed and accepted only through an authorised Canyon Controls distributor or representative, on that party’s own terms of sale.

3. Specifications and changes

Specifications, features, ratings, dimensions, finishes, SKUs and appearance described on the Site are subject to change without notice. Canyon Controls is engaged in continuous product development and reserves the right to alter or discontinue any product at any time.

Product photography and renderings are representative. Colours and finishes shown on a screen will not match a physical sample exactly; request a sample before making a finish selection.

Where a published specification sheet and a page on this Site disagree, the specification sheet governs. Always confirm you are working from the current revision before issuing a submittal — the revision date is printed on every sheet, and the current set is on the Downloads page.

4. Certifications and listings

References on this Site to ASHRAE 90.1, the IECC, or Title 24 Part 6 describe capabilities the equipment can be used to help satisfy. They are not a certification of compliance. Whether a given installation complies depends on the system design, how it is commissioned, and which code edition your jurisdiction has adopted. Confirm with the authority having jurisdiction.

5. The configurator

The system configurator is a preliminary budgeting and planning aid. It applies simplified assumptions to the few inputs you give it, and it cannot see your drawings, your load schedule, your ceiling heights, your daylight conditions, or your local code amendments.

Its output is an estimate, not a design. It is not a bill of materials, not a construction document, and not a substitute for engineering by a qualified professional. Every configurator result must be reviewed and stamped by a licensed engineer or qualified lighting designer before it is issued for construction, bid or permit. Canyon Controls accepts no responsibility for quantities, selections or costs derived from it.

6. Installation and code compliance

Canyon Controls equipment operates on line voltage and must be installed by a qualified, licensed electrician in accordance with the product installation instructions, the National Electrical Code (NFPA 70), and all applicable state and local codes. Improper installation can cause fire, electric shock, injury or death.

Do not deviate from the published wiring, torque, clearance and environmental limits. Do not install or energise a product that is visibly damaged. Responsibility for safe installation, inspection, permitting and commissioning rests with the installing contractor and the project’s design professionals.

7. Intellectual property

The Site and its contents — text, layout, photography, renderings, drawings, diagrams, icons, software and code — are owned by Canyon Controls or its licensors and are protected by copyright and other laws. “Canyon Controls,” “Olympus,” “Aspen,” “Tahoma” and “Sierra” are trademarks of Canyon Controls.

You may view, print and share the Site’s pages for the purpose of evaluating, specifying or installing Canyon Controls products. You may not scrape, mirror, resell, or incorporate the content into another product or database; remove proprietary notices; or use our marks in a way that suggests endorsement or affiliation without written permission.

8. Downloaded documents

Specification sheets, manuals and drawings offered on the Downloads page may be downloaded, reproduced and distributed without alteration and complete with all notices intact, for use in submittals, specifications and project records.

Do not edit these documents, extract ratings into a datasheet of your own, or present their content as anything other than Canyon Controls’ published data. Each document states its own revision; older revisions may be superseded without notice, and it is the user’s responsibility to verify they hold the current one.

9. Third-party links

The Site may link to sites we do not control. Those links are offered for convenience and are not an endorsement. We are not responsible for third-party content, products or privacy practices.

10. Disclaimer of warranties

The Site and its content are provided “as is” and “as available,” without warranty of any kind, express or implied. To the fullest extent permitted by law, Canyon Controls disclaims all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Site will be uninterrupted or error-free, or that its content is accurate, complete or current. We make no representation that any product is appropriate or available for use in a particular location.

This section concerns the Site. The separate limited warranty covering Canyon Controls hardware is published at Warranty, and nothing here limits it.

11. Limitation of liability

To the fullest extent permitted by law, Canyon Controls and its officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, loss of use, cost of substitute goods, or business interruption, arising out of or relating to your use of the Site — whether the claim sounds in contract, tort, strict liability or otherwise, and even if we were advised such damages were possible.

Our total aggregate liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limitations above apply to the greatest extent those laws permit, and nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify and hold harmless Canyon Controls from claims, damages, liabilities and reasonable legal costs arising out of your misuse of the Site, your breach of these terms, or your violation of any law or third-party right in connection with the Site.

13. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts sitting in the State of New York have exclusive jurisdiction over any dispute arising out of or relating to the Site or these terms, and you consent to their jurisdiction and venue.

If a provision of these terms is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will stay in force. Our failure to enforce a provision is not a waiver of it.

14. Changes to these terms

We may revise these terms at any time by posting an updated version here and changing the effective date. Your continued use of the Site after a revision constitutes acceptance of it. Review this page periodically.
